Terms of Service

These terms are the agreement between you and [COMPANY LEGAL NAME] (“we”, “us”) about your use of Moe. Downloading, installing or using Moe means you accept them. If you do not accept them, do not use Moe.
1. What Moe is
Moe is an application you download and run on your own Mac. Speech recognition and speech synthesis run on your machine. Moe does not include an AI model of its own: to use the agent you connect an AI provider you already have — a Claude or ChatGPT subscription, an API key, or a model running locally — and you connect the accounts and services you want it to reach.
We do not operate a server that your data passes through. There is no Moe account to create. What that means for your data in detail is in the privacy policy, which forms part of these terms.
2. Your licence to use Moe
We grant you a personal, worldwide, non-exclusive, non-transferable, revocable licence to install and use Moe on Macs you own or control, for your own purposes, personal or commercial. Moe is provided free of charge.
You may not sell, rent or sublicense Moe as a product of your own, remove or alter its notices of ownership or attribution, or represent it as something you made.
Moe includes third-party open-source software and open models. Each of those is licensed to you by its own author under its own licence, and those licences govern that component and override anything in this section that conflicts with them. The full list is on the licences page and in the app.
3. Services you connect
Moe is useful because you point it at things: an AI provider, your mail, your calendar, your files, a messaging service. Each of those is operated by someone else, under their own terms and their own privacy policy, and your agreement with them is yours, not ours. Connecting a service through Moe does not change it.
You must be entitled to connect the accounts you connect, and you must keep to the terms of the services you reach through Moe. If a provider changes its rules, its prices, or its access, or withdraws it altogether, that part of Moe may stop working and we are not responsible for the consequences.
Anything you send to an AI provider through Moe — your requests and the context that goes with them — is received and handled by that provider under their terms, not ours.
4. What you are responsible for
Moe acts on your instructions with your credentials, from your Mac. You are responsible for what it does on your behalf, including anything it sends. Before Moe sends a message or an email for you it shows you exactly what will go out and waits for you to confirm it; confirming is your decision, and the message is yours.
You are responsible for the security of your own machine and your own credentials, and for keeping backups of anything you would not want to lose. Moe stores its memory, transcripts and settings as plain files on your disk; deleting them deletes them.
5. Acceptable use
Do not use Moe:
- to break the law, or to help anyone else break it;
- to reach an account, mailbox, calendar or file you are not entitled to reach;
- to send unsolicited bulk messages or email, or to impersonate anyone;
- to harass, threaten, defraud or harm another person;
- to collect or process other people’s personal data in a way that breaks the law that applies to you;
- to work around a service’s own terms, rate limits or access controls;
- to interfere with Moe’s safeguards, including the step that asks you to confirm before anything is sent.
Because Moe runs entirely on your Mac, we have no way to see what you do with it and no ability to police it. This section says what the licence permits: use it outside these limits and you are outside the licence.
6. No warranty
Moe is provided “as is” and “as available”, without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, title or non-infringement. We do not warrant that Moe will be uninterrupted, error-free, or free of harmful components, that transcription or any model output will be accurate, or that it will work with any particular service, machine or version of macOS.
Moe uses AI models. Model output can be wrong, and can be confidently wrong. Check anything that matters before you rely on it.
Some jurisdictions do not allow the exclusion of certain warranties or of statutory consumer rights. Where that is so, this section applies only as far as the law allows, and nothing here limits rights you have that cannot be limited.
7. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or business, arising out of or relating to Moe, however caused and on any theory of liability, even if we have been advised that such damages are possible.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to Moe will not exceed the greater of the amount you paid us for Moe in the twelve months before the claim (which, for the free version, is nothing) or fifty US dollars.
Nothing in these terms excludes or limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be excluded or limited.
8. Changes to Moe and to these terms
We may change, add to, or discontinue Moe or any part of it. We may update these terms — to reflect a change in the app, or in the law. When we do, we will change the date at the top of this page, and if the change is material we will say so on this site before it takes effect. Continuing to use Moe after a change means you accept the updated terms. The current version always lives at moebot.app/terms.
9. Termination
You may stop at any time: quit Moe, disconnect the services you connected, and delete the app and its files. Nothing is held on our side that needs closing down.
Your licence under section 2 ends if you break these terms. We may also stop distributing Moe, or stop supporting a version of it, at any time. Sections 3, 4, 6, 7, 10 and 11 survive the end of this agreement.
10. Governing law
These terms, and any dispute arising out of them or out of your use of Moe, are governed by the laws of [JURISDICTION — set before launch], without regard to its conflict-of-laws rules, and the courts of [JURISDICTION — set before launch] have exclusive jurisdiction. If you use Moe as a consumer, this does not deprive you of the protection of the mandatory law of the country you live in.
11. The rest
These terms, together with the privacy policy and the third-party licences, are the whole agreement between you and us about Moe. If a provision is held unenforceable, the rest stands. Not enforcing a provision is not a waiver of it. You may not assign this agreement; we may assign it as part of a transfer of the business.
